Introduction Digital Services Act
The Digital Services Act (hereafter DSA) regulates online intermediaries and platforms such as marketplaces, social networks, content-sharing platforms, app stores, and online travel and accommodation platforms. Its main goal is to prevent illegal and harmful activities online and the spread of disinformation. It ensures user safety, protects fundamental rights, and creates a fair and open online platform environment. The DSA rules apply to all platforms since 17 February 2024.
To which organisations does the DSA apply?
- Intermediary services (e.g. mere conduit, caching or hosting services)
- Online platforms (e.g. B2C online marketplaces, social networks and app stores)
- Online search engines (e.g. Google and Bing)
- Very large online platforms (Vlops) (e.g. Facebook, X and Zalando)
What obligations does the DSA impose on businesses?
The DSA imposes several obligations on businesses that can be divided in four themes. 1) Address illegal content, 2) Protection of minors, 3) Rights to recipients and 4) Trustworthiness of Business-to-Consumer (B2C) online platforms. What obligations apply, depends on your type of services.
